Objectives: This workshop is being convened to provide a forum to discuss current issues relating to the inclusion of patented technology and software in standards. International experts from both the public and private sectors will help provide an overview of the issues and share their insights on present and future developments.

11:30 - 13:30 Session 1: SDO’s perspectives

Objectives: This session will examine the current patented policy debates taking place within standards-setting bodies from different geographical regions. These organizations and their stakeholders often deliberate whether certain proposals to revise their operative patent policy will – or will not - improve the standards-setting process and make it more effective or efficient. The panelists will provide insight into the issues recently or currently being debated at the standards-setting organization they each represent and the conclusions that were reached.

14:30 - 16:00 Session 2: Industry perspectives (Part I)

Objectives: This session will discuss the concept of “F/RAND” (“fair, reasonable and non-discriminatory”), how it works in practice, and whether it is effective or needs further definition. Panelists will also discuss issues related to aggregated royalties (when there are a significant number of necessary patents and/or patent holders) as well as the mechanisms that have been put in place, or should be put in place, to solve this issue. Finally, the impact of non-practicing entities on the standard system will be examined.

Objectives: This session will focus on the perspectives of representatives from the public sector on some of the current issues being debated. It will, in particular, discuss the role of government and public authorities in providing input on patent policy approaches being considered or adopted by standards-setting organizations.

Objectives: This final session will include panelists from SDOs and industry who will provide practical guidance and tips on issues to be addressed when considering the incorporation of software into standards.
